General Orders No 22
I Before the Military Court appointed for this Corps were arraigned and tried the following named persons.
viz.

22d Asst Surgeon T. D. Merritt 18th Miss Inf.
Charge 1st Drunkenness on Duty
Charge 2nd Misbehavior before the enemy
Charge 3rd Wilful misapplication of Hospital
stores belonging to the Confederate States
The Court having considered the evidence are is unable to agree on a judgment & respectfully forward the record.

II The Court, in the case of Asst Surgeon T. D. Merritt 18th Mass. Inf., failing to agree as to the guilt or innocence of the accused, and by reason of the very great doubt apparent in the record as to the guilt of the accused, and in consideration of the length of time which has elapsed since his trial, and upon the approval of the Department of War, the charges are dismissed, and the accused, if in arrest, will be restored to duty.
