The first Proposals which
Andy Johnson rejected.
Memorandum of basis of ageements made this 18th day of April A.D. 1865, near Durhams station in the state of No Ca, by & between Genl Jos E. Johnson, commanding the Confederate Army, & Major Genl Wm T. Sherman, commanding the Army of the U.S. in No Ca present.
1st The contending Armies now in the field to maintain the "Status quo" until notice is given by the commanding General of any one to its opponent, & reasonable time, say forty-eight hours allowed.
2nd The Confederate armies now in existence to be disbanded, and conducted to their several State Capitals, there to deposit their arms, & public property in the State arsenal; & each Officer & man to /

execute & file an agreement to cease from acts of war, & to abide the action of both State & Federal authority. The number of arms & munitions of war to be reported to the Chief of Ordnance, at Washington City, subject to the future action of the Congress of the U. States, & in the meantime to be used solely to maintain peace & order within the borders of the States respectively.
3rd The recognition by the Executive of the U.S. of the several State governments, on their Officers, & Legislatures taking the oaths prescribed by the Constitution of the UStates & where conflicting State Governments have resulted from the war, the legitimacy of all shall be submitted to the Supreme Court of the UStates.
4th The re-establishing of all /

the Federal Courts in the several States, with powers as defined by the Constitution, & laws of Congress.
5th The People & Inhabitants of all the States to be guaranteed so far as the Executive can, their political rights of person, & property, as defined by the Constitution of the US & of the States respectively.
6th The Executive Authority of the Government of the U. States not to disturb any of the People by reason of the late war, so long as they live in peace & quiet, abstain from acts of armed hostility, & obey the laws, in existence at the place of their residence.
7th In general terms the war to cease, a general amnesty so far as the Executive of the UStates can command, on condition that of the disbandment of the Confederate /

Armies, the distribution of the arms, & the resumption of peaceful pursuits by the Officers & men, hitherto composing said armies. Not being
fully empowered by our respective Principals to fulfil these terms, we individually & officially pledge ourselves to promptly obtain the necessary authority & to carry out the above programme.

Terms
Of a Military Convention entered into this twenty sixth (26th) day of April 1865 at Bennetts House, near Durham's Station N.C., between Genl Jos E Johnson, Commanding the Confederate Army, & Maj Genl W. T. Sherman, Commanding the UStates Army in No Ca—:
1 All acts of War on the part of the Troops under Genl Johnson's command to cease from this date.
2nd All arms, & public property to be deposited at Greensboro' & delivered to an Ordnance Officer, of the U.S. Army.
3rd Rolls of all the Officers & men to be made in duplicate, one copy to be retained by the Commander of the Troops, & the other to be given to an Officer to be designated /

Genl Sherman. Each Officer & man to give his individual obligation in writing not to take up arms against the Gov of the U.S. until properly released from this obligation.
4th The side arms of Officers & their private horses, & baggage to be retained by them.
5th This being done, all the Officers & men will be permitted to return to their homes, not to be disturbed by the U.S. Authorities, so long as they observe their obligation, & the laws in force where they may reside Signed

Military Convention of April 26th 1865
Supplemental Terms.
(Still pending)
1st The Confederate troops to retain their field transportation.
2nd Each Brigade, or separate Body to retain a number of arms equal to one fifth of its effective total, which when the Troops reach their homes, will be recd by the local authorities for Police purposes.
3rd Officers & men to be released from the "obligation" at the same time with those of the army of Va.
4th Artillery horses to be used in field transportation when necessary.
5th The horses & other private property of Officers & men to be /

retained by them.
6th Troops from Arkansas & Texas to be transported by water from Mobile or N. Orleans to their homes by the U. States.
8th Naval Forces within limits of Gen Johnson's Command to have the benefit of the stipulations, of this Convention.
9 The obligations of private soldiers to be signed by their Company Commanders.
The armistice & Convention were proposed by Gen Johnson. When Andy Johnson rejected the terms, Sherman gave notice of the resumption of hostilities. Genl Johnson then proposed a renewal of the armistice, for further negotiation which resulted in the terms adopted.
