I certify on honor that on the 23d day of January near Dumfries Va the stores enumerated below was lost while in my possession and charge as actg. ord. off. of the Division under the following circumstances.
The Division was at that time on the march from Dumfries to the Chopawamsic Creek, the roads were exceedingly bad making it very difficult for loaded trains to make any progress. On the two days previous the trains had been able to get not more than two or three miles from Dumfries though in the road all day. Maj. Genl. Slocum, commdg. the Corps, therefore directed verbally by his Staff that to prevent further detention of the Corps by the trains, all Wagons which could not get through readily with their loads should be unloaded and the Stores abandoned. He at the same time directed that the officers serving in the Quartermasters, Commissary's and Ordnance Department at Dumfries should subsequently send out trains and collect the stores so thrown out from the trains. During the morning Maj. Genl. Slocum passing the trains came to two Wagons of my train stuck fast in the mud, and ordered all the ammunition in one to be unloaded and part of that in the other. this was at the rear of the train and / I was at the time near the head and when I returned to the rear the last Wagon was some distance from where the ammunition had been unloaded so that I could not recover it as I otherwise should have done. The Ammunition was however collected subsequently by Lieut. E. R. Anthony 5th Ohio Vols. then actg. ord. off. 1st Brigade 2d Div. 12th A.C. stationed at Dumfries. The undersigned being duly sworn, deposes and says, that he was actg Ordnance Sergeant with the Ordnance Train of the 2d Div. 12th A.C. in December 1862 & January 1863, that he is cognizant of the facts above set forth and that they are correct to the best of his knowledge and belief.
