If Mrs Hills piano is not held by an agent of the U. S. Treasury or by the Freedmans Beaureau but held by an officer or private person she or the owner ought to bring an action of repleven and take posession of it. If a military officer had captured the piano it was his duty to hand it over to the proper authority but he cannot seize and use private property and ought not to be permitted to do so
